disclaimer\uff0c\u7b80\u79f0TD\uff09\u3002\u82e5\u975e\u5982\u6b64\uff0c\u56db\u4ef6\u7cfb\u4e89\u4e13\u5229\u53ca\u5f15\u8bc1\u6848\u2019036\u4e13\u5229\u7684\u4e13\u5229\u6743\u671f\u95f4\uff0c\u5e94\u540c\u6b65\u4e8e1997\u5e7410\u67086\u65e5\u5230\u671f\uff0c\u60df\u53d7PTA\u5236\u5ea6\u5f71\u54cd\uff0c\u6388\u6743\u65f6\u65e0PTA\u8865\u507f\u7684\u5f15\u8bc1\u6848\u2019036\u4e13\u5229\uff0c\u5728\u76f8\u5173\u6848\u4ef6\u4e2d\u5230\u671f\u65e5\u6700\u65e9\u3002<\/p>\n<p>\u672c\u6848\u4eceUSPTO\u5355\u65b9\u518d\u5ba1\u67e5\u7a0b\u5e8f\u3001PTAB\u8bc9\u613f\uff08appeal\uff09\u7a0b\u5e8f\uff0c\u5230CAFC\u4e0a\u8bc9\u6848\u5ba1\u7406\uff0c\u4e00\u8def\u88ab\u8ba4\u5b9a \u2019742\u3001\u2019369\u3001\u2019626\u3001\u2019621\u4e13\u5229\u53d1\u660e\u90fd\u662f\u2019036\u4e13\u5229\u53d1\u660e\u663e\u800c\u6613\u89c1\u7684\u53d8\u4f53\uff08obvious variant\uff09\uff0c\u6bd4\u5bf9\u7684\u56db\u4ef6\u7cfb\u4e89\u4e13\u5229\u4e0e\u5f15\u8bc1\u6848\u2019036\u4e13\u5229\u7684\u4e13\u5229\u8303\u56f4\uff0c\u5224\u65ad\u7686\u4e8e\u53ef\u4e13\u5229\u6027\u65e0\u53ef\u533a\u522b\uff08patentably indistinct\uff09\uff0c\u7cfb\u663e\u800c\u6613\u89c1\u578b\u91cd\u590d\u6388\u6743\uff08Obviousness-type Double Patenting\uff0c\u7b80\u79f0ODP\uff09\uff0c\u4e14\u56e0\u76f8\u5173\u4e13\u5229\u7684\u4e13\u5229\u6743\u671f\u95f4\u90fd\u5df2\u5230\u671f\uff0c\u65e0\u6cd5\u63d0TD\u8865\u6551\uff0c\u5bfc\u81f4\u2019742\u3001\u2019369\u3001\u2019626\u3001\u2019621\u56db\u4ef6\u4e13\u5229\u56e0\u65e0\u6cd5\u514b\u670dODP\u95ee\u9898\u800c\u65e0\u6548\u3002<\/p>\n<p #026292;\">\u5224\u51b3\u91cd\u70b9<\/span><\/p>\n<p>\u4f9d\u90e8\u5206\u7f8e\u56fd\u4e13\u5229\u4ece\u4e1a\u4eba\u5458\u6574\u7406<a class=\"Article_content_15px\" href=\"https:\/\/naipnews.naipo.com\/zh-hans\/71053#1\">[1]<\/a>\uff0c\u672c\u6848\u5224\u51b3\u91cd\u70b9\u662f\uff0c\u4e00\u6388\u6743\u4e13\u5229\u82e5\u56e0\u7533\u8bf7\u671f\u95f4\u5b98\u65b9\u4f5c\u4e1a\u5ef6\u8bef\u800c\u6709PTA\u8865\u507f\uff0c\u65e0\u8bba\u8be5\u6848\u662f\u5426\u66fe\u63d0TD\uff0c\u7686\u5e94\u4ee5PTA\u8c03\u6574\u540e\u7684\u5230\u671f\u65e5\u5224\u65ad\u662f\u5426\u6709ODP\u95ee\u9898\uff0c\u4e14\u4e00\u65e6\u4e13\u5229\u6743\u671f\u95f4\u5c4a\u6ee1\uff0c\u5373\u65e0\u6cd5\u518d\u4ee5TD\u8865\u6551\u3002<\/p>\n<p>\u6309\u5148\u524d\u5224\u4f8b<a class=\"Article_content_15px\" href=\"https:\/\/naipnews.naipo.com\/zh-hans\/71053#1\">[2]<\/a>\uff0c\u82e5\u56e0\u7533\u8bf7\u836f\u54c1\u8bb8\u53ef\u8bc1\u4e8e\u4e3b\u7ba1\u673a\u5173\u67e5\u9a8c\u671f\u95f4\u65e0\u6cd5\u5b9e\u65bd\u4e13\u5229\u53d1\u660e\uff0c\u8fdb\u800c\u53d6\u5f97\u4e86\u4e13\u5229\u6743\u671f\u95f4\u5ef6\u957f\uff08Patent Term Extension\uff0c\u7b80\u79f0PTE\uff09\uff0c\u5bfc\u81f4\u590d\u6570\u4e13\u5229\u7684\u4e13\u5229\u6743\u671f\u95f4\u5230\u671f\u65e5\u4e0d\u540c\uff0c\u5e94\u4ee5PTE\u8c03\u6574\u524d\u7684\u5230\u671f\u65e5\u505a\u91cd\u590d\u6388\u6743\u5206\u6790\uff0c\u56e0\u6b64\u4e0d\u4f1a\u6709ODP\u95ee\u9898\u3002\u4f4635 U.S.C. 154\u89c4\u8303\u7684PTA\uff0c\u5176\u5236\u5ea6\u3001\u6e90\u7531\u7686\u4e0d\u540c\u4e8e35 U.S.C. 156\u89c4\u8303\u7684PTE\uff0cTD\u4f1a\u526a\u9664\u591a\u4f59\u7684PTA\u5929\u6570\uff0c\u800cPTE\u5929\u6570\u4e0d\u56e0TD\u7f29\u51cf\uff0cODP\u5206\u6790\u5e94\u4ee5\u52a0\u8ba1PTA\u5929\u6570\u540e\u7684\u5230\u671f\u65e5\u4e3a\u51c6\u3002\u56e0\u6b64\uff0c\u540e\u7533\u8bf7\u3001\u65e0PTA\u3001\u4e13\u5229\u6743\u671f\u95f4\u8f83\u65e9\u5230\u671f\u7684\u4e13\u5229\uff08\u5982\u672c\u6848\u5f15\u8bc1\u6587\u732e\u2019036\u4e13\u5229\uff09\uff0c\u53ef\u4f5c\u5148\u7533\u8bf7\u3001\u6709PTA\u3001\u4e13\u5229\u6743\u671f\u95f4\u8f83\u665a\u5230\u671f\u4e13\u5229\uff08\u5982\u672c\u6848\u56db\u4ef6\u7cfb\u4e89\u4e13\u5229\uff09\u7684ODP\u5f15\u8bc1\u6570\u636e\u3002<\/p>\n<p>\u5728USPTO\u7a0b\u5e8f\u53caCAFC\u8bc9\u8bbc\u671f\u95f4\uff0cCellect\u591a\u9879\u4e3b\u5f20\u90fd\u672a\u4e3aUSPTO\u53caCAFC\u63a5\u53d7\u3002\u4f8b\u5982\uff0cCellect\u8ba4\u4e3a\uff0c\u5373\u4f7f\u6709ODP\u95ee\u9898\uff0c\u53ea\u5e94\u79fb\u9664PTA\u5929\u6570\uff0c\u4e5f\u5c31\u662f\u7cfb\u4e89\u4e13\u5229\u7684\u4e13\u5229\u6743\u671f\u95f4\u7f29\u51cf\uff0c\u800c\u975e\u5168\u90e8\u56db\u4ef6\u7cfb\u4e89\u4e13\u5229\u6574\u4ef6\u4e13\u5229\u65e0\u6548\uff1b\u4f46CAFC\u6307\u6b64\u4e00\u65b9\u5f0f\u7b49\u540c\u4e8e\u56de\u6eaf\u63a5\u53d7TD\uff0c\u56e0\u6b64\u65e0\u6cd5\u652f\u6301\u8fd9\u4e00\u8bba\u70b9\u3002\u53c8\u5982\uff0cCellect\u4e3b\u5f20\u7533\u8bf7\u671f\u95f4\u7686\u8bda\u5b9e\u5e94\u5bf9\uff08good faith\uff09\uff0cODP\u53ea\u5e94\u7528\u4ee5\u904f\u963b\u9632\u72af\u84c4\u610f\u94bb\u5236\u5ea6\u6f0f\u6d1e\u3001\u4e0d\u5f53\u5ef6\u957f\u4e13\u5229\u6743\u4fdd\u62a4\u671f\u95f4\u7684\u53d6\u5de7\u884c\u4e3a\uff08gamesmanship\uff09\uff1b\u4f46CAFC\u8868\u793a\uff0c\u5373\u4f7f\u80fd\u8bc1\u660e\u7533\u8bf7\u671f\u95f4\u5df2\u5c3d\u8bda\u5b9e\u4e49\u52a1\uff0c\u4e0d\u4ee3\u8868\u6709\u6743\u4eab\u6709\u672c\u5c31\u65e0\u6743\u53d6\u5f97\u7684\u4e13\u5229\u6743\u671f\u95f4\u5c55\u5ef6\u3002\u518d\u5982\uff0cCellect\u66fe\u4e3b\u5f20\uff0c\u7533\u8bf7\u671f\u95f4\u540c\u5bb6\u65cf\u6848\u4ef6\u90fd\u662f\u540c\u4e00\u5ba1\u67e5\u5b98\u5ba1\u67e5\uff0c\u8be5\u5ba1\u67e5\u5b98\u5fc5\u5b9a\u8003\u8651\u8fc7ODP\u95ee\u9898\uff0c\u5374\u672a\u66fe\u5728\u4efb\u4e00\u6848\u53d1ODP\u6838\u9a73\uff0c\u6240\u4ee5\u672c\u6765\u5c31\u6ca1\u6709\u53ef\u4e13\u5229\u6027\u5b9e\u8d28\u65b0\u95ee\u9898\uff08substantial new question of patentability\uff0c\u7b80\u79f0SNQ\uff09\u80fd\u542f\u52a8\u5355\u65b9\u518d\u5ba1\u67e5\u7a0b\u5e8f\u7684\u5b9e\u5ba1\uff1b\u4f46CAFC\u6307\u51fa\uff0cCellect\u65e0\u6cd5\u4e3e\u8bc1USPTO\u5ba1\u67e5\u5b98\u66fe\u660e\u786e\u8868\u793a\u8003\u8651\u8fc7\u540c\u65cf\u6848\u4ef6\u6709\u65e0ODP\u95ee\u9898\u3002<\/p>\n<p class=\"Article_tittle_3_blue_bold\" style=\"font-size: 36px;\"><span style=\"color: #026292;\">\u5404\u65b9\u89c2\u5bdf<\/span><\/p>\n<p>\u5e38\u89c1\u7684\u4e00\u79cd\u7533\u8bf7\u7b56\u7565\u662f\u5148\u5c31\u8bf4\u660e\u4e66\u63ed\u9732\u7684\u6700\u91cd\u8981\u53d1\u660e\u5185\u5bb9\u53d6\u5f97\u4e13\u5229\u3001\u9886\u53d6PTA\uff0c\u81f3\u4e8e\u8bf4\u660e\u4e66\u63ed\u9732\u7684\u5176\u4ed6\u53d1\u660e\u5185\u5bb9\u53ca\u6280\u672f\u7a81\u7834\uff0c\u5219\u53e6\u63d0\u5b50\u6848\u4e89\u53d6\u4e13\u5229\uff0c\u8fd9\u79cd\u7533\u8bf7\u7b56\u7565\uff0c\u5e38\u7531\u6b64\u884d\u751f\u8bb8\u591a\u4e0d\u540c\u5230\u671f\u65e5\u7684\u5ef6\u7eed\u6848\u4e13\u5229\u3002\u4e0d\u53ea\u4e00\u4f4d\u7f8e\u56fd\u4e13\u5229\u5f8b\u5e08\u56e0\u6b64\u63d0\u9192\uff0c\u8fd9\u7c7b\u7533\u8bf7\u4f5c\u6cd5\u53ef\u80fd\u5bfc\u81f4\u5b50\u6848\u88ab\u7528\u4ee5\u526a\u53bb\u4e3b\u8981\u4e13\u5229\u7684PTA\u5929\u6570\u3001ODP\u88ab\u7528\u4ee5\u63d0\u9ad8\u7533\u8bf7\u4eba\u5c31\u5173\u8054\u6280\u672f\u7533\u8bf7\u590d\u6570\u4e13\u5229\u7684\u96be\u5ea6\uff0c\u7533\u8bf7\u4eba\u52a1\u987b\u6ce8\u610f\u672c\u6848\u5224\u51b3\u53ca\u540e\u7eed\u53d1\u5c55\u3002<\/p>\n<p>\u591a\u4f4d\u7f8e\u56fd\u4e13\u5229\u5f8b\u5e08\u5efa\u8bae\u68c0\u8ba8\u4e13\u5229\u7533\u8bf7\u7b56\u7565\uff0c\u8b6c\u5982\uff1a<\/p>\n<ul>\n<li>\u5728\u540c\u4e00\u4e13\u5229\u7533\u8bf7\u6848\u5199\u8fdb\u66f4\u591a\u8bf7\u6c42\u9879\uff0c\u540e\u7533\u8bf7\u6848\u53ea\u5199\u4e0e\u5148\u7533\u8bf7\u6848\u4e8e\u53ef\u4e13\u5229\u6027\u6709\u53ef\u533a\u522b\uff08patentably
